US Processing Enclaves (No UK Data Residency)
When SMEs sign up for Meta Premium or integrate AI via the WhatsApp Business API, they are not getting dedicated UK servers. Meta handles commercial AI requests using what they call "Private Processing enclaves." However, these enclaves are hosted in the United States.

The "Opt-Out" Nightmare for Training Data
Meta's entire corporate DNA is built on harvesting data to train models (like Llama). Recently, Meta faced massive backlash from the Irish Data Protection Commission (DPC) and the UK Information Commissioner's Office (ICO) for relying on "legitimate interest" to train AI on user data.

While WhatsApp consumer chats are end-to-end encrypted, messages sent to AI business bots are not. Meta's servers process the raw text of these messages to generate a response. Sending Article 9 data to a US company known for aggressive metadata harvesting is a direct violation of SRA guidance and GDPR strictures.
30-Day Minimum Retention of API Logs
For true legal compliance, an AI provider must offer zero-data retention (where data is deleted the millisecond the AI generates a response). Meta AI Business does not offer this.
